Terms of Service

Welcome to The Wishing App. These Terms of Service ("Terms") are an agreement between you and UWish LLC, a Colorado limited liability company ("The Wishing App," "we," "us"). By using The Wishing App website (the "Service"), you agree to these Terms. If you don't agree, please don't use the Service.

1. Who can use The Wishing App

The Service is not meant for children under 13. If you're between 13 and 18, please use it with the permission of a parent or guardian.

2. What The Wishing App is

The Wishing App is a free digital entertainment experience, a modern wishing well. You choose a well, write a wish, toss a virtual coin, and let it go. There's no account to create and nothing to buy.

3. What The Wishing App is not

The Wishing App is not gambling, a lottery, a sweepstakes, a contest, or any form of betting. Making a wish never costs anything, and nothing of value ever comes out. The virtual coin has no cash value and exists only as part of the experience. There are no prizes, payouts, or winnings of any kind, and optional support (section 7) has no effect on any wish.

We make no promise about whether any wish will come true. The Wishing App is about the act of hoping, not about outcomes.

4. Your wishes

Your wishes are yours. When you toss a coin, your words travel to our server so the toss can be counted, and are then discarded without being saved, logged, reviewed, or shared. Because we never keep them, we can't show them back to you, recover them, or delete them later, since there's nothing to delete. Please don't include anything in a wish that you'd need to keep.

5. Acceptable use

Please don't: use the Service to break any law; attempt to hack, overload, reverse-engineer, or disrupt it; use bots, scripts, or automated tools to submit wishes or inflate counts; or get around any limits we put in place to keep the Service running smoothly. We may limit or block access that we reasonably believe is abusive or automated.

6. Sponsors and outside links

Some wells may, from time to time, carry a short line naming a sponsor who helps keep the Service running. Sponsored lines are clearly labeled. A sponsorship doesn't mean we endorse the sponsor's products, and it has no connection to your wishes, which sponsors never see. Links to other websites are provided for convenience; we're not responsible for their content or practices. Businesses that sponsor a well do so under a separate agreement with us.

7. Optional support

You may choose to make a voluntary payment to UWish LLC to help keep the Service running ("support"). Support is entirely optional. It doesn't purchase any product, feature, or benefit, doesn't change your experience in any way, and has no connection to any wish. UWish LLC is a for-profit company, not a charity, so support is not a charitable donation and is not tax-deductible.

Support payments are processed by Stripe on Stripe's secure checkout page and are subject to Stripe's terms. Because support is voluntary and nothing is provided in exchange, payments are generally non-refundable. If you made a payment by mistake, such as the wrong amount or a duplicate, email us within 14 days and we'll make it right.

8. Our content

The Wishing App name, the wells and their stories, artwork, animations, writing, software, and design are owned by UWish LLC or our licensors and are protected by law. You may use the Service for its intended personal purpose. Nothing in these Terms transfers ownership of any of it to you.

9. Earlier coin purchases

Before this version, the Service sold virtual coins under our previous Terms and Token & Refund Policy. Coin purchases and accounts were retired on September 24, 2026. If you have a question about a past purchase, email us and we'll help.

10. Changes to the Service

We may add, change, or remove features at any time, and we may stop offering the Service. Because the Service is free and we store nothing of yours, discontinuing it won't cost you anything beyond any optional support you chose to give.

11. Disclaimers

The Service is provided free, "as is," and "as available," without warranties of any kind, to the fullest extent the law allows. We don't guarantee it will be uninterrupted, error-free, or always available.

12. Limitation of liability

To the fullest extent permitted by law, UWish LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed $100.

13. Indemnification

You agree to defend and indemnify UWish LLC against claims arising from your misuse of the Service or your violation of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Jefferson County, Colorado, and you consent to that jurisdiction.

15. Changes to these Terms

When we update these Terms, we'll post the new version here with a new version number and effective date, and keep earlier versions available in the version history below. Continuing to use the Service after an update means you accept the new version.
