Terms of Service

Welcome to The Wishing App. These Terms of Service ("Terms") are a legal agreement between you and UWish LLC, a Colorado limited liability company ("The Wishing App," "we," "us"). By creating an account, buying tokens, or using The Wishing App app or website (the "Service"), you agree to these Terms. If you don't agree, please don't use the Service.

1. Who can use The Wishing App

You must be at least 18 years old to use the Service. By using it, you confirm you meet this requirement and that the information you provide is accurate.

2. What The Wishing App is

The Wishing App is a digital entertainment service, a modern wishing well. You make a wish, toss a token, and let it go. The Wishing App is for entertainment only.

3. What The Wishing App is not

The Wishing App is not gambling, a lottery, a sweepstakes, a contest of chance, a game of skill played for value, or any form of betting or wagering. Tokens have no cash value, cannot be redeemed for money or anything of monetary value, and there are no prizes, payouts, or winnings of any kind. See the Token & Refund Policy for full details.

4. Your account

You're responsible for your account and for keeping your login secure. Don't share your account or let anyone else use it. Tell us right away if you think your account has been compromised.

5. Acceptable use

You agree not to: break any law; harass, threaten, or harm others; post content that is illegal, abusive, hateful, or infringing; attempt to hack, overload, reverse-engineer, or disrupt the Service; use bots or automated tools without our written permission; or use the Service for any financial purpose. We may suspend or terminate accounts that violate these Terms.

6. Your content

You keep ownership of the wishes and content you create. By posting, you give The Wishing App a non-exclusive, worldwide, royalty-free license to host, display, and use that content to operate and improve the Service. You're responsible for the content you post and confirm you have the right to post it.

7. Our content

The Wishing App name, logo, software, design, and all materials we provide are owned by The Wishing App or our licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. Nothing here transfers ownership to you.

8. Purchases

Token purchases are governed by the Token & Refund Policy, which is part of these Terms. All prices are in U.S. dollars and exclude applicable taxes unless stated.

9. Changes to the Service

We may add, change, or remove features at any time, and we may stop offering the Service. We'll give reasonable notice of material changes where we can.

10. Termination

You can stop using the Service anytime. We may suspend or end your access if you violate these Terms or for any lawful reason. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. We don't guarantee the Service will be uninterrupted, error-free, or secure.

12. Limitation of liability

To the fullest extent permitted by law, The Wishing App will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the prior 12 months or $100.

13. Indemnification

You agree to defend and indemnify The Wishing App from claims arising out of your use of the Service, your content, or your violation of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Jefferson County, Colorado, and you consent to that jurisdiction.

15. Changes to these Terms

We may update these Terms. If we make material changes, we'll post the new version with a new effective date and, where appropriate, notify you. Continuing to use the Service means you accept the updated Terms.
